Memorial woman sues Harley Davidson, claims defective helmet

A Memorial woman is suing the manufacturer of a motorcycle helmet, claiming its defective design caused her husband's death.
Donna Roy filed suit in the Harris County District Court on Oct. 25 against Harley-Davidson, alleging the motorcycle company is strictly liable for a manufacturing defect in her husband's helmet.
Donna Roy's husband, Robert, was driving eastbound on FM 1960 when he was forced to take evasive action to avoid a wreck. Robert Roy applied his brakes and struck another vehicle.
He was transported to Memorial Hermann Hospital and later died on Jan. 12, 2009.
The suit claims the blow to Roy's head was survivable, but killed him because of the improper design of the helmet he was wearing, which was manufactured by Harley-Davidson.
Donna Roy is seeking past and future damages for loss of companionship, mental anguish and loss of inheritance.
