A MARYBOROUGH woman gave evidence yesterday in the ongoing trial of five men allegedly linked to the Rebels Motorcycle Club.
Kerrie-Anne Mackie owns a small business with her husband on the opposite side of the street to where the co-accused are alleged to have threatened Kris and Emma Bust.
Mrs Mackie said she could not hear anything that was said during the incident on December 6, 2008, but she could see Mr and Mrs Bust's body language clearly.
“They looked like they were intimidated” she told the court.
She described Mr Bust as standing “very timidly” – slightly hunched with his hands held down in front of him, while Mrs Bust used a lot of hand gestures and “looked like she was pleading".
“They (Mr and Mrs Bust) almost liked like little kids who have done something naughty” Mrs Mackie said, before the four defence barristers began their cross-examination.
During questioning, Mrs Mackie admitted she did not see anything out of the ordinary in the body language of the men on trial that could have resulted in Mr and Mrs Bust feeling intimidated, with the defence noting she did not see anyone “gesticulating wildly” or acting in an obviously aggressive manner.
Earlier, Kris Bust repeated the evidence he gave in court last week before the mistrial, including his earlier confusion about which of the defendants made what exact comments during the incident.
The trial of Adam Warwick McCrea, Gary Wayne Hyland, Sean Edwin Foster, Peter Ross Hill and Mark Darren Berghoffer continues today.
