AUSTRAILIA - 'Nude bikie' bashing over mate's death
OFF THE WIRE
AN "ENRAGED'' nude Finks bikie bashed his watch-house cellmate after discovering he was charged with the murder of a close family friend, a court has heard. Kris Spizzirri, 29, is charged with assault occasioning bodily harm for allegedly raining blows on his cellmate Christopher James Cairns in a frenzied 90-second attack at the Southport Watchhouse cell on May 27.
Cairns, 27, had been in custody charged with murdering and robbing Tumara Cousins, who died after falling 31 storeys from a Surfers Paradise high-rise.
In the Southport Magistrates Court today, Spizzirri's lawyer Adam Magill said officers had placed Cairns in Spizzirri's cell during the night and it was during morning showers that Spizzirri learned of Cairns' charges.
Mr Magill said Cousins had been a "close family friend'' of the Spizzirris, The Gold Coast Bulletin reported.
"He was told (Cairns) was responsible for killing his mate and he reacted instantly,'' he said.
"He simply lost his composure and assaulted him.''
CCTV footage of the alleged incident was played in court allegedly showing Spizzirri emerging from the shower wearing only a towel around his waist and delivering a flurry of punches to Cairns who had been laying under a blanket on his bed.
The footage allegedly shows Spizzirri losing his towel and continuing to punch and stomp on Cairns as he lay on the floor.
Spizzirri is then seen to put shorts on and leave the open cell before watchhouse officers arrived to help remove Cairns.
Mr Magill told the court there were major mitigating factors for the incident and sought bail for his client.
Police prosecutor Trudy Jobberns argued bail should be refused as Spizzirri had a lengthy criminal history.
He is already on Supreme Court bail for drug trafficking charges and on a parole order.
Earlier this morning Magistrate Terry Duroux placed Spizzirri on a three-month suspended sentence for obstructing police during a watch house altercation on May 26.
Mr Duroux ruled Spizzirri's higher court bail conditions combined with his parole order were sufficiently strict to grant him bail.
He will return to court for the assault charge on September 4.
