AUSTRALIA - Brawler to await appeal outcome

FORMER gxxg member Dylan Jessen won't be sentenced for his role in a brawl until after his appeal.In June, the Adelaide Magistrates Court found Jessen, 21, of Elizabeth East, guilty of affray.

The charge related to the same incident over which New Boys leader Vince Focarelli and member Michael Syfris were last week acquitted. The pair were found to be acting in self-defence during the April 2010 altercation between several of the New Boys and the Hells Angels.

In Jessen's trial, Deputy Chief Magistrate Andrew Cannon dismissed the former Central District footballer's self-defence claims.

Yesterday, Dr Cannon said he would await the outcome of the appeal because of the "apparent unfairness" between the two cases.

"These circumstances are unusual because I'm aware of a separate trial on the same set of facts and basically the same evidence which arrived at an acquittal," he said. "It's desirable that the apparent unfairness between you and the other parties be resolved before sentence."

Jessen also yesterday sought a bail variation to start a new job, but was unsuccessful.

He is due to be sentenced in October.
