The San Diego Police today started testing a small camera and tape recorder worn on the ear like a blue-tooth.
Fran suggested that discussions on this could be around what questions someone could or could not answer, or should not answer, and would you and I be able to get a copy of the tape, if we were arrested.

Mark,answered this with a comment, that we all need to remember

You never have to answer questions, and especially without a lawyer present.
I would never use a lawyer, but it is accepted that questions cannot force an answer when your Counsel is not with you to advise.

Yes, you can require the prosecution to supply the tape if the conversation resulted in an arrest (ticket) in California. It is required as part of the Discovery process when both sides share information that will be used in the hearing.
