Wisconsin - Man gets probation in Franklin tavern beating.....

A Greenfield man convicted in a vicious Franklin tavern beating on July 4, 2008, after which the victim died from painkillers and a sleeping pill, was sentenced Monday to probation.
Justin Leszczynski and Daniel Hintz were charged in 2009 with beating a 41-year-old Franklin man at the Irish Cottage, 11433 W. Ryan Road.
Donald L. Sieben died three days later. While police first considered it a possible murder case, a medical examiner determined his cause of death was drugs he took for pain and to sleep after being released from the hospital, where he had been treated for several injuries suffered in the beating.
Many people who saw the attack refused to cooperate or deliberately misled investigators, police said. Several said they feared retaliation because the suspects were believed to be part of the Black Pistons, an affiliate of the Outlaws Motorcycle Club. Police finally brought aggravated battery charges after they seized boots from the defendants that matched marks on the victim.
Leszczynski, 26, pleaded guilty in November to an amended charge of substantial battery as party to a crime.
On Monday, Milwaukee County Circuit Judge David Hansher sentenced him to 18 months in prison followed by two years of extended supervision but suspended the sentence in favor of three years of probation. As a condition of the probation, Leszczynski must serve five months at the County Correctional Facility-South, with work-release privileges.
Hansher also ordered he have no contact with Hintz and not return to the Irish Cottage.
Hintz, 34, of St. Francis, pleaded guilty to the same amended charge in May, and was sentenced in July to 18 months in prison and two years of extended supervision. He originally had been charged with aggravated battery and two counts of threatening to injure a witness.
