Mr Hathaway,

I can respond to the following;

• We have increased enforcement with non-compliant (novelty) helmets. VT experienced 4 fatalities in 2009 with riders wearing these type of helmets.

• The law was amended in the 2009 legislative session.

• The fine / waiver is $156 and two points.

• VT takes pride in being a safe state and the emphasis on riders is having the "right" gear.

23 VSA § 1256. Motorcycles-Headgear

A person may not operate or ride upon a motorcycle upon a highway unless he or she properly wears protective headgear of a type that conforms to the federal Motor Vehicle Safety Standards contained in 49 C.F.R. part 571.218 and any amendment or addition to the regulations that may be adopted by the U.S. Secretary of Transportation.
