- On JUNE 28, 2012, a lawsuit was filed in U.S. District Federal Court in Boise, Idaho. ( case No: 12-330-CV-LMB ) This action was brought against the UNITED STATES of AMERICA, the UNITED STATES DEPARTMENT of VETERANS AFFAIRS, and, the SECRETARY OF VETERANS AFFAIRS, ERIC SHINSEKI.
The complaint alleges DEPRIVATION of CIVIL RIGHTS, and the INTENTIONAL INFLICTION of EMOTIONAL and PHYSICAL DISTRESS, and, BREACH OF CONTRACT, BREACH of FIDUCUARY DUTY, and, OTHER COMPLAINTS of VETERANS and IMMEDIATE FAMILY.
This action is brought under TITLES 5, 15, 18, 38, & 42 U.S.C. and TITLE 38 CFR.
The class action covers the placement of a “ false & stigmatizing “ computer coded number or alphabetical code upon the main employment reference document of ALL 23 MILLION veterans ( THE DD-214 or Separation document ) without their knowledge. This raises a RED FLAG of Due Process of Law.
In CASEY v. U.S. 8 Cl. Ct. 234 (1985) Judge YOCK stated a veteran with a coded number should have had a due process hearing. The Dept. of Veterans Affairs has there coded numbers in their computer systems such as; VADS, BIRLS, and the new VISTA systems.
Presidential Administrations did not allow for the wounded when they calculated the cost of the VIETNAM, to current wars. The rise in financial costs to the nation of keeping it’s contract to care for an ever increasing number of veterans has lead to substandard care leading to the deaths of thousands of veterans whose lives could have been saved had they proper medical care. The PROOF of the systemic nature and direction of this effort resides in the decades of delays and “ spoliation “ of Veterans Disability claims. Officially documented actions by BOARD of VETERANS APPEALS EMPLOYEES who were caught destroying over 100,000 claims file folders is more than just proof. Recently investigators discovered that 42 of 57 V.A. REGIONAL OFFICES had illegally shredded documents which shines a bright light upon organized criminal conduct.
We hear big words from Washington, D.C. that: the laws are equal for all, nobody is above the law, and this is a nation governed by the rule of law. Governmental 0fficials speak these words but, do not live by them.
NO where can a veteran get equal protection under the law against criminal acts committed by V.A. Employees. There is NO EQUALITY of access to the Courts for veterans of the United States America.
There is NO protection under the law for the veteran who served to preserve the law.
This litigation points out the many shortcomings of the U.S. Department of Veterans Affairs and its anti-veteran attitude.
This litigation is brought before the U.S. Federal Courts on behalf of all those disenfranchised veterans who have NO ONE to speak for them. This litigation hopes to bring JUSTICE to those who spent part of their lives on the battlefield of LIBERTY, so that others could live the easy life.
