Tort Reform/Seat Belts/Comparative Negligence H.3375, RELATING TO THE PENALTIES FOR THE MANDATORY USE OF SEATBELTS, SO AS TO DELETE THE PROVISION THAT PROVIDED THAT A VIOLATION FOR FAILURE TO WEAR A SEATBELT IS NOT NEGLIGENCE PER SE OR COMPARATIVE NEGLIGENCE AND IS NOT ADMISSIBLE IN A CIVIL ACTION.

In plain English, if you are not wearing a seat belt and are involved in an accident (even if you are not at fault), you may not receive as much compensation in a law suit or from an insurance company, because you were not wearing a seat belt. If this passes, expect helmets will be the next target!

Accident Causing Death S.263, WHICH PROXIMATELY CAUSES DEATH TO A PERSON, IS GUILTY OF THE MISDEMEANOR OFFENSE OF VEHICULAR HOMICIDE...TO PROVIDE THAT A PERSON MUST SUBMIT TO EITHER ONE OR A COMBINATION OF CHEMICAL TESTS OF HIS BREATH, BLOOD, OR URINE

This bill needs to have the mandatory drug testing removed - otherwise it is a rights violation and it will negate the effectiveness of the law.
