WINNIPEG, Manitoba, Jan. 4 (UPI) -- A former leader of the Hells Angels biker gang in Manitoba, Canada, has sued the wrong government for seizing and selling his home, officials said.
A civil lawsuit filed in Winnipeg by a lawyer for Ernie Dew, 53, alleges the provincial government of Manitoba had no right to take his home after 2006 his arrest on drug charges.
"The government has misused and/or exceeded the power of its public office," the suit claims. "This was a reckless, wanton and egregious disregard of his rights."
However, provincial sources told the newspaper it wasn't Manitoba that seized the property, but rather the federal government.
The sources suggested Dew and his lawyer might have been confused by the fact Manitoba did seize the bikers' clubhouse in 2009 in a separate law enforcement action.
The newspaper said the lawsuit naming the wrong government would likely be quickly dismissed and Dew would have to launch another one naming the federal government.
He faces sentencing Jan. 18 for cocaine trafficking and possession of goods obtained by crime.
