THE NSW government is failing to protect the people of western Sydney amid "out of control" gun crime by not letting police use anti-bikie laws, the state opposition says.
Legislation was passed last March allowing the NSW Police Commissioner to apply to the Supreme Court to have a particular gaxxx declared a criminal organization.
An amendment was introduced in November so the laws could apply across other state jurisdictions.
But Attorney-General Greg Smith on Tuesday said police would hold off from using the laws until a High Court challenge to similar Queensland legislation was resolved.
"If any aspect of the Queensland legislation is found to be invalid, the NSW government will review all provisions of the bill in light of the High Court's findings," a spokeswoman for Mr Smith said in a statement.
The attorney-general said the government was committed to giving NSW police the best possible powers to crack down on outlaw motorcycle gaxxx violence.
