MI woman avoids jail in negligent homicide case

MARQUETTE -- The Marquette County woman charged with negligent homicide following a fatal vehicle and motorcycle crash received a 12-month delay of sentencing, which means she will see no jail time if she has no other violations in the next year.
In August, 60-year-old Barbara Helberg's minivan pulled into the path of 18-year-old motorcyclist, Daniel Beck. He was later pronounced dead.
Surveillance video and accident reconstruction reports supported that Beck was obeying the speed limit, had the proper lights on his motorcycle, and hit his breaks hard in attempt to avoid a collision.
Helberg plead guilty to the charge of negligent homicide.
Beck's parents appeared in court to share victim impact statements. They felt a delay in sentence would not send the message that the public needs to be vigilant when driving and asked for Helberg's license to be revoked permanently.
The 12-month delay in sentence was part of a plea agreement with the prosecution, one that Judge Thomas L Solka admitted he wasn't sure if he would accept when approaching the bench.
"If there is any message to go forward, it's that people have to pay attention to the road, have to keep both hands on the wheel, have to keep their eyes on the road for what's there to be seen," says Solka.
Helberg had no prior criminal offenses. She will have her license revoked for a 12-month period, must serve 100 hours community service, and pay court costs and fines.
Helberg's attorney requested a work driving permit during the 12-month period; Judge Solka denied that request.
