A motorcycle gang member escaped prison Wednesday after admitting he had two loaded guns at the scene of shootout during which a fellow Iron Horseman was killed by police.

Lew Erskine, 47, was placed on probation Wednesday for four years by Hamilton County Common Pleas Court Judge Pat DeWine.

Harold Seavey was the member of the Iron Horseman motorcycle club killed by Cincinnati police in the Sept. 18 incident at J.D.'s Honkytonk in the 2400 block of Spring Grove Avenue.
"It was a terrible day that day. Mr. Erskine lost a brother," Erskine's lawyer told the judge.
Erskine, the owner of a Bethel motorcycle shop, was at the Camp Washington bar with two guns that day. He has permits for them but, by Ohio law, wasn't allowed to have them on bar property. At least two Cincinnati police officers were wounded in the shootout. Erskine did not fire his guns.
When the judge asked Erskine on Wednesday why he was at the bar with two loaded guns, Erskine replied, "I don't know."
The judge ordered the two guns confiscated and for Erskine to stay away from the bar.
