A New York Police Department Says It’s Illegal to Own Handguns as a Member of a Motorcycle Club

The unconstitutional harassment of the Pagans Motorcycle Club on Long Island continues at an accelerated pace. Following the militarized “show of force” at a charity event hosted by the Pagans MC October 17th, which resulted in massive civil liberty violations, the Suffolk County Police Department continues its campaign of unconstitutional harassment. The SCPD is confiscating the handguns of members of the Pagans MC that have no criminal record and have been issued legal permits by Suffolk County.

Motorcycle clubs, including the Pagans MC, are constitutionally protected associations and the right to bear arms is fundamental. “Anyone concerned with government overriding legal mechanisms allowing gun ownership should be highly concerned about law enforcement’s obvious attempts to disarm members of motorcycle clubs based on nothing more than association.”  (See It’s Illegal For Motorcycle Club Members To Own Guns? that’s What Authorities Say August 25, 2015)

So what is the SCPD doing?  On Thursday October 22nd, the SCPD contacted a member of the Pagans MC and informed him that his legal permit issued by Suffolk County was under review because of his alleged membership in the Pagans MC. The SCPD requested that he come down to the station for an interview and bring all 10 of his legally purchased and registered handguns.

The member, in good faith, says he went down to the station with his legal handguns in order to be interviewed. This member has absolutely no criminal record and he had been legally issued a permit. He thought he could clear it up, he says.

But the SCPD had no intention of making an evaluation based on the interview. It is clear that the decision to confiscate this man’s legal handguns was made before he ever arrived. The member was given no real choice. He was told he could give up being a Pagan and keep his permit and guns. Police told him that it is illegal to own a gun in New York as a member of an outlaw motorcycle club like the Pagans. Police said there was recent Supreme Court precedent that confirmed the law.

The man says he was told that as a member of the Pagans his only options were to either voluntarily terminate his permit and turn his guns over or his permit would be involuntarily terminated and he would lose all of his guns unable to transfer them to a legal owner. And he says they warned he could spend thousands on an appeal which he would never win and still lose his property. The member, coerced into an impossible choice, says he voluntarily relinquished his permit and handed over his legally owned property.

Although any attorney will tell you that you should always have an attorney when dealing with law enforcement, and incidents like this are exactly why, SCPD’s actions are deplorable and inexcusable. The right to associate as a member of a motorcycle club, including the Pagans, has been confirmed by case law. (See How Waco Is Being Used To Decimate The 1st Amendment JUNE 26, 2015). Unfortunately, there is no law against the police lying to you, it happens in criminal investigations all the time, and they often get people to relinquish their own rights.

This man did not commit a crime. Law enforcement is defining membership in a group they label a gang as a crime (a group that has validated 1st Amendment protection) with no judicial check on due process for that determination.

“Simply carrying a legal gun as a member of a motorcycle club, including a 1% club, is not a crime.”  This seems abundantly clear when an individual possesses a permit.  “The courts have concluded that motorcycle club associations and colors, including 1% clubs, are protected by the 1st Amendment. It is not illegal to be in a club, otherwise they could arrest an individual for wearing colors. “In a very real way, the fate of motorcyclists will serve as a blue print for other groups in the future. Disarming bikers is a strategy to cripple the rights base of one of the most visible and active grassroots social and political movements in America. Much of the movement’s efforts are to combat civil liberty abuses by law enforcement targeting motorcyclists. If bikers are successfully marginalized as criminals not worthy of baseline liberties, then the strength of our political movement exposing law enforcement abuses will be crippled as well. Two Floridians get free marijuana for life -- from the feds

TAMPA (FOX 13) - You know the federal government bans marijuana, and that a medical marijuana referendum in Florida failed last year. But you may not know that the U.S. government still provides marijuana to people in Florida.

It all started in with a man named Bob Randall, who successfully argued for medical marijuana in court and received it as part of a legal settlement.

In 1978, the United States started the Compassionate Investigational New Drug Program. It provides medicinal marijuana to people with serious health problems for life.

While the George H.W. Bush administration closed enrollment in 1992, people in this program are still receiving monthly shipments.

The FDA would not say how many people who joined this program are still living. We found records leading to four, including two people in Florida: Irvin Rosenfeld and Elvy Musikka.

"The United States federal government has been supplying me 10 marijuana cigarettes per day for almost 33 years, and in the same vein arresting people for possessing marijuana they give me for medical use," said Rosenfeld, who began receiving medical cannabis under this program in 1982.

The marijuana is grown in a secured facility at the University of Mississippi.

Rosenfeld uses it to treat a rare bone tumor disorder.  Musikka uses it to treat glaucoma, and has for the past 27 years.

They both receive a tin of marijuana each month, and are instructed to use 10 marijuana cigarettes a day. They both say it works for them and that they've been stopped by law enforcement officers who 

are unaware of their legal right to use and possess it.

They also say that many federal lawmakers are unaware of the Compassionate IND.

"They're always surprised -- didn't know the government ever supplied anybody," added Mussika.

US House Passes Long-Term Highway Bill. The bill—the first long-term highway bill passed by the US House in decades—is matched by a similar bill passed earlier this year by the Senate. First, the bill ends the federal funding of motorcycle-only checkpoints, a top priority of the Motorcycle Riders Foundation. The bill also re-convenes the National Motorcycle Advisory Council (NMAC), an advisory council that advises the Secretary of Transportation on how infrastructure issues affect motorcyclists in ways that are vastly different than for four-wheeled vehicles. Lastly, the bill commissions a study to determine the best ways to prevent motorcycle crashes. Because it focuses only on prevention rather than on helmet use, this study would be the first of its kind.

Graves-led bill authorizes federal highway programs for 6 years

WASHINGTON, D.C. – U.S. Representative Sam Graves, Chairman of the House Subcommittee on Highways and Transit, issued the following statement after the House today passed the Surface Transportation Reauthorization and Reform Act. The bipartisan, six-year Highway Bill cleared the House by a vote of 371-54.
“Properly investing in and modernizing this country’s transportation infrastructure should be a top priority of the federal government,” Rep. Graves said. “But for the past decade, states have been forced to operate off of one short-term Highway extension after another, making their job nearly impossible.”
“A long-term Highway Bill is essential to all of those responsible for maintaining America’s roads and bridges,” Rep. Graves continued. “In Missouri, we have over 35,000 highway miles and 10,000 roadway bridges that need to be repaired, rebuilt or altogether replaced. Each state deserves the certainty to plan these projects with confidence, and this bipartisan bill will give them just that.”

BACKGROUND INFORMATION: The Surface Transportation Reauthorization and Reform Act of 2015 will reauthorize federal highway programs for six years. Specifically, the bill targets duplicative regulatory processes, streamlines environmental reviews for highway projects, and maintains that 15% of a state’s federal highway funding must be used on the maintenance and restoration of rural bridges.
The long-term Highway Bill also gives states the flexibility to focus on the safety needs unique to each community, allowing them to take advantage of new technologies that will reduce accidents and roadway fatalities. And by requiring the Federal Motor Carrier Safety Administration (FMCSA) to review regulations every five years to ensure they are current, consistent, and relevant, we can preserve policies that save lives and abandon those that do not.
