A MAN convicted of a Perth murder 10 years ago will have his assets confiscated after losing an appeal to the High Court.
Gary Ernest White, a member of a bikie gang, is serving a life sentence for the wilful murder of Anthony Tapley in suburban Maddington in 2001.
Western Australia's director of public prosecutions had applied to seize White's assets because the shooting occurred on a property which had been leased, rather than owned, by White.
Under West Australian law, criminals can have their assets confiscated if property used in the relevant crime is neither owned nor controlled by them.
Last year, the WA Court of Appeal overturned a ruling which dismissed the application by the DPP to seize the 56-year-old's assets.
But White appealed the decision to the High Court.
The High Court has ruled that the Court of Appeal was correct in its ruling.
