PENN, - Defense asks eastern Pa. judge to exclude statements, video in trial over crash that killed 2

EASTON, Pa. — A defense attorney is asking a judge to toss out alleged statements by a distraught eastern Pennsylvania driver following a crash that killed two motorcyclists last summer.

The attorney for 49-year-old John Heaney III also asked a Northampton County judge on Friday not to allow use of a police video showing his client taking field sobriety tests.

Heaney, of Lopatcong Township, N.J., is scheduled to stand trial in May on vehicular homicide and involuntary manslaughter charges in the July 1 crash in Bangor that killed two members of the Last Chance Motorcycle Club on their way to a funeral and injured six others.

Defense attorney Dennis Charles says the alleged statements were made before his client had received a Miranda warning, and use of the video would unduly prejudice jurors.
