GANNON William E. II (Bill) 59 of Quincy, formerly of Ashmont Hill, Dorchester, passed away on December 24, 2012 at home. He was the son of the late Teresa M Gannon and William E. Gannon. He was the loving father of three daughters, Kimberly Gannon O'Connor of Weymouth, Jennifer Dunlea, of Quincy, and Jacqui Durante of Mims, Florida. He was a father figure to Robyn Sharpe of Jamaica Plain. He was a loving grandfather to Samantha, Kailee, Zachary, Keegan, Kaylan, and Keira,. His is survived by one brother, John of Quincy, and three sisters, Maureen Gannon of Rochester, VT, Nancy Mahoney of Braintree, and Patricia Gannon of Quincy and eight nieces and nephews. He was employed for many years by Fallon Ambulance Service, and he was a motorcycle enthusiast, political activist, journalist, and a talented photographer. His love of music led him to work regularly as a concert photographer of rock musicians. Bill will most be remembered for his love of his family and all children. Relatives and friends are respectfully invited to attend the Mass of Christian Burial Thursday at 10:00 A.M. in St. Ann’s Church, 757 Hancock St., Quincy. PASSING OF MRF FOUNDER AND FORMER CHAIRMAN BILLY GANNON

Billy Gannon, 59, passed away on December 24th following a courageous battle with cancer. Billy was a member of the original Meeting of the Minds Steering Committee and one of the founders of what would become the Motorcycle Riders Foundation located in Washington D.C. Billy was key in convincing motorcyclists rights representatives from the east coast to attend the first Meeting of the Minds. Billy took over from Michael "Balls" Farabaugh as the organizations Chairman in 1987 and then served as Co-Chair with Michael in 1988. One of the first messages I received about Billy's passing was, "Billy Gannon has left this world to ride with those who have left before us. Every motorcyclist lost a freedom fighter today".

CHEYENNE, Wyo. — A federal judge is dismissing a lawsuit in which a Florida man claimed Lincoln County sheriff's deputies violated his Second Amendment rights by arresting him for carrying a handgun.

Judge Scott Skavdahl of Casper announced Dec. 19 that he will grant a request from Lincoln County and the state of Wyoming to dismiss the lawsuit filed by Robert Pierson, of Pensacola, Fla. Pierson had been riding his Harley-Davidson through Lincoln County with a pistol on his belt in August 2011. A U.S. Marine Corps helicopter pilot who has served two combat tours in Afghanistan, he has said he was taking a cross-country trip that brought him through Wyoming. Deputies stopped Pierson near Alpine after another motorist complained that a motorcyclist matching his description had been driving recklessly.

Pierson claims in the lawsuit filed this year that Deputies Corry Bassett and Rob Andazola handcuffed him for 45 minutes while questioning him about his gun. Although Pierson was handcuffed, the deputies didn't disarm him and he wasn't cited. In a sworn statement filed in court this fall, Bassett told Pierson's attorney, Gary Ferguson, that he detained Pierson because Pierson wouldn't tell him initially whether he had a gun.

Pierson, who recorded much of his interaction with Bassett and Andazola, told Bassett only that he didn't consent to any searches.

Pierson stated that the lawmen's safety wasn't his concern, and that their safety didn't trump his constitutional rights. He later posted the recording of his encounter on YouTube, where it has been viewed more than 100,000 times.

Bassett gave a sworn statement to lawyers in the case this fall that he offered to release Pierson if he allowed Andazola to draw his weapon and cover Pierson, ready to shoot him if he made any sudden moves.

Pierson declined the offer and was released after a supervisor from the Lincoln County sheriff's office arrived.

Ferguson said Friday he will review Skavdahl's written dismissal order once it's filed and intends to appeal.

Ferguson said earlier court cases have established that police may detain an armed man who hasn't committed a crime only if he's dangerous.

"But he wasn't dangerous," Ferguson said of Pierson.

"And you can clearly show that from the recording that he made. You can see that he wasn't dangerous. How do you let officers off when they're illegally and unconstitutionally threatening lethal force?"

Sheriff Shane Johnson said Friday it's been frustrating to have the lawsuit pending and to be under orders from his attorneys not to comment. He said he received emails from people around the country who had seen Pierson's You-Tube posting that were critical of his department.

"This was never about a gun," Johnson said.

"There is no organization that's more pro-Second Amendment than this organization. It was frustrating to have this turned into like this was anti-gun." Johnson said Pierson didn't stop immediately when the deputy turned on his emergency lights to pull him over. He said the deputy had a heightened state of awareness after finding that Pierson was armed and hearing him say that the deputy's safety wasn't his concern. "We expect everybody in Wyoming to have a firearm, obviously. We're aware of that," Johnson said. "We don't pull over people because we see firearms, which is what this was made out to be: we saw somebody carrying a firearm so we decided to stop him. That's absolutely inaccurate."

CA - La Mesa resident prevails in illegal search case

Four years ago, La Mesa police Officer Mike Stanton stepped out of his patrol car and shouted at a man crossing Thorne Street to stop.
That routine bit of police work, and the events that followed in the next few minutes, has turned into something more. Because of a ruling by the 9th U.S. Circuit Court of Appeals this month, the outcome of that encounter might end up changing how police officers are trained and go about their work.
A three-judge panel of the court ruled that when police officers are pursuing someone who might be guilty of nothing more than a simple misdemeanor, they cannot barge on to private property in pursuit of the suspect.
Instead, they would have to ask permission to enter the property or get a search warrant — all to avoid violating the Fourth Amendment, which protects citizens against illegal searches and seizures by law enforcement.
In this case, when Stanton yelled, “Police!,” the man didn’t stop, according to court records. Nicholas Patrick instead continued to walk slowly across the street, then through a wooden gate into the front yard of Drendolyn Sims’ home.
The gate, part of a 6-foot tall wooden fence that surrounded the property, closed behind Patrick.
The officer then approached the house and without warning kicked in the gate. It flew off of its hinges and struck Sims, who was standing next to it on the other side, inside her yard.
She was knocked unconscious and fell to the ground, court records say, and suffered a shoulder injury that later required surgery. She sued Stanton and the city of La Mesa for $500,000, claiming the officer violated her constitutional rights against unlawful searches by the government.
The case was thrown out in San Diego federal court. But on Dec. 3, the panel of appeals court judges reinstated the case, ruling there was no legal justification for Stanton to enter Sims’ home, and that the officer was not immune from being sued.
The ruling could mean officers pursuing suspects — say possible drunken drivers who pull into their own driveways and enter their homes — may have to get search warrants.
Under the law, police are allowed to go on to private property in the “hot pursuit” of fleeing suspects believed to have committed serious felony crimes such as murder or assault.
But this month’s ruling written by the 9th Circuit’s most well-known liberal, Judge Stephen Reinhardt, said that power does not apply if police are chasing someone guilty of no more than a low-level misdemeanor.
That was the case in the incident in La Mesa. Officers had been called to the neighborhood because of a brawl in the street. But when Stanton and his partner arrived, all was calm, according to the ruling.
Only Patrick and two other men, who also walked away in the opposite direction, were there, said Sims’ lawyer, L. Marcel Stewart, who argued and won the case.
At the most, by not stopping when police called to him, Patrick may have committed the crime of disobeying a lawful order from a police officer. That’s a misdemeanor in California.

The law allows police to enter private property under certain circumstances, such as the potential for the destruction of evidence or that a suspect will flee. It also allows for emergencies, such as immediate danger to the public or police.
In this instance, neither applied, Reinhardt said.
The officer’s lawyer, Peter Ferguson, argued that Stanton did not want Patrick to escape, but the panel said that was not “a serious enough consequence to justify a warrantless entry,” because the arrest would only be for a minor crime.
Stanton also said he feared for his safety, arguing that he was concerned Patrick could enter the home, arm himself and come back out.
That, too, was discounted by the appeals court panel, which said there “was simply no evidence of imminent danger to the officer or anyone else.”
Stewart said the decision draws a bright line on when police can enter private property.
“The officer can’t say, ‘Because he committed a minor crime I’m going to pursue him on to private residential property,’” he said. “It makes the law very clear now. If you have a misdemeanor, a minor offense, you can’t do it.”
Ron Cottingham, president of the Peace Officers Research Association of California, a labor group representing more than 60,000 law enforcement officers in California, said if the decision stands, “it would change the face of police work and how we operate.”
Cottingham said such a ruling could put officers in danger if they hesitate to mentally determine if someone they are chasing has committed a misdemeanor or a felony.
Ferguson has asked a larger panel of the court to take up the opinion and review it. Failing that, he said he will ask the U.S. Supreme Court to take up the matter and is being backed up by law enforcement groups that have learned of the decision.
He contended that the opinion misinterprets the law on what police can do when pursuing someone, and conflicts with state law and rulings from other federal appeals courts.
As it stands now, Ferguson said, the opinion hinders the ability of police to chase and capture suspects.
“Officers are taught when you see a crime committed in a public place, you have a right to go get that individual without a search warrant,” he said. “This opinion, if it stands, creates a lot of problems for that aspect of their training.”
Stewart said the court noted there was no evidence when the officers arrived on the street that a crime had taken place or was ongoing. When Patrick was caught later, he possessed no weapons.
If the ruling stands, the case would return to federal court in San Diego and perhaps could go to trial or be settled.

The growing menace of cop motorcycle clubs claimed another victim last Saturday night. The victim, a 23-year-old man from Glendale, Arizona, was attacked in a Prescott, Arizona bar by multiple assailants. He told police at the Yavapai Regional Medical Center that he had been attacked by members of a “motorcycle gang.”
Prescott police immediately imposed a news blackout on the incident except to say that they were turning the investigation over to the Arizona Department of Public Safety’s Special Investigations Unit. Prescott police admitted that they had “gathered evidence” at the crime scene.
A Department of Public Safety spokesman named Carrick Cook said, “There was an incident involving members of the Prescott Valley Police Department. No arrests have been made and the investigation continues. There is limited information that is available during an active criminal investigation.”

The Iron Brotherhood
The assailants were members of the Iron Brotherhood Motorcycle Club. The IBMC describes itself as “a no bullshit, non political Law Enforcement MC.” The club was founded in Southern California in 2006.
On its national website the IBMC states: “Members of the Iron Brotherhood respect all clubs and the colors they wear. However members of this club do not associate with members of one percenter clubs. We also do not attend events sanctioned by one percenter clubs.” The club accepts current and former male cops as hang arounds and prospects.
In a display of their “respect” for “all clubs and the colors they wear” the national website states, “The Iron Brotherhood MC wears three piece colors because we can. We are a Law Enforcement club and will not seek permission from any organization to fly our colors.”

The patch holders involved in the assault included members from Prescott’s Whiskey Row Chapter. The club has twenty chapters from coast to coast in the United States. Whiskey Row is a block on South Montezuma Street in downtown Prescott that was once home to 40 saloons. The assault occurred during The Whiskey Row chapter’s annual Christmas Party.
The phenomena of cop clubs is virtually invisible to non-biker civilians. But, people who do know about these clubs are often infuriated by them.
One cop who reported his contempt for clubs like the Iron Brotherhood is celebrity ATF agent Jay Dobyns. Dobyns wrote about his attempted infiltration and entrapment of Hells Angels in Arizona in a book called No Angel. According to Dobyns, he encountered a cop club called the Wild Pigs in the parking lot of Harley dealership in Bellemont, Arizona about 70 miles north of Prescott. Dobyns categorizes cop clubs as an “abomination” and he claims to have said the following to a Wild Pigs patch holder: “You can’t have it both ways, asshole. You can’t pretend to look and act like us until the shit gets nasty and then pull a badge and gun and sit us down on the side of the road. Fuck you. Pick a side.”
Dobyns’ book is so full of inaccuracies that the conversation may be completely invented. And Dobyns is hardly a friend of bikers in general. But the quote probably reveals his true feelings about cop clubs. And, it is reprinted here because even a blind squirrel comes up with a nut from time to time.

Letter from an airline pilot: He writes:

My lead flight attendant came to me and said, "We have an H.R. On this flight." (H.R. Stands for human remains.) "Are they military?" I asked.

'Yes', she said.

'Is there an escort?' I asked.

'Yes, I've already assigned him a seat'.

'Would you please tell him to come to the flight deck. You can board him early," I said..

A short while later, a young army sergeant entered the flight deck. He was the image of the perfectly dressed soldier. He introduced himself and I asked him about his soldier. The escorts of these fallen soldiers talk about them as if they are still alive and still with us.

'My soldier is on his way back to Virginia ,' he said. He proceeded to answer my questions, but offered no words.

I asked him if there was anything I could do for him and he said no. I told him that he had the toughest job in the military and that I appreciated the work that he does for the families of our fallen soldiers. The first officer and I got up out of our seats to shake his hand. He left the flight deck to find his seat.

We completed our pre-flight checks, pushed back and performed an uneventful departure. About 30 minutes into our flight I received a call from the lead flight attendant in the cabin. 'I just found out the family of the soldier we are carrying, is on board', she said. She then proceeded to tell me that the father, mother, wife and 2-year old daughter were escorting their son, husband, and father home. The family was upset because they were unable to see the container that the soldier was in before we left. We were on our way to a major hub at which the family was going to wait four hours for the connecting flight home to Virginia .

The father of the soldier told the flight attendant that knowing his son was below him in the cargo compartment and being unable to see him was too much for him and the family to bear. He had asked the flight attendant if there was anything that could be done to allow them to see him upon our arrival. The family wanted to be outside by the cargo door to watch the soldier being taken off the airplane. I could hear the desperation in the flight attendants voice when she asked me if there was anything I could do. 'I'm on it', I said. I told her that I would get back to her.

Airborne communication with my company normally occurs in the form of e-mail like messages. I decided to bypass this system and contact my flight dispatcher directly on a
Secondary radio. There is a radio operator in the operations control center who connects you to the telephone of the dispatcher. I was in direct contact with the dispatcher. I explained the situation I had on board with the family and what it was the family wanted. He said he understood and that he would get back to me.

Two hours went by and I had not heard from the dispatcher. We were going to get busy soon and I needed to know what to tell the family. I sent a text message asking for an update. I
Saved the return message from the dispatcher and the following is the text:

'Captain, sorry it has taken so long to get back to you. There is policy on this now and I had to check on a few things. Upon your arrival a dedicated escort team will meet the aircraft.
The team will escort the family to the ramp and plane side. A van will be used to load the remains with a secondary van for the family. The family will be taken to their departure area and escorted into the terminal where the remains can be seen on the ramp. It is a private area for the family only. When the connecting aircraft arrives, the family will be escorted onto the ramp and plane side to watch the remains being loaded for the final leg home. Captain, most of us here in flight control are veterans.. Please pass our condolences on to the family. Thanks.'
I sent a message back telling flight control thanks for a good job. I printed out the message and gave it to the lead flight attendant to pass on to the father. The lead flight attendant was very thankful and told me, 'You have no idea how much this will mean to them.'

Things started getting busy for the descent, approach and landing. After landing, we cleared the runway and taxied to the ramp area. The ramp is huge with 15 gates on either side of the alleyway. It is always a busy area with aircraft maneuvering every which way to enter and exit. When we entered the ramp and checked in with the ramp controller, we were told
That all traffic was being held for us.

'There is a team in place to meet the aircraft', we were told. It looked like it was all coming together, then I realized that once we turned the seat belt sign off, everyone would stand up at once and delay the family from getting off the airplane. As we approached our gate, I asked the co-pilot to tell the ramp controller we were going to stop short of the gate to
make an announcement to the passengers. He did that and the ramp controller said, 'Take your time.'

I stopped the aircraft and set the parking brake. I pushed the public address button and said, 'Ladies and gentleman, this is your Captain speaking I have stopped short of our gate to make a special announcement. We have a passenger on board who deserves our honor and respect. His Name is Private XXXXXX, a soldier who recently lost his life. Private XXXXXX is under your feet in the cargo hold. Escorting him today is Army Sergeant XXXXXXX. Also, on board are his father, mother, wife, and daughter. Your entire flight crew is asking for all passengers to remain in their seats to allow the family to exit the aircraft first. Thank you.'

We continued the turn to the gate, came to a stop and started our shutdown procedures. A couple of minutes later I opened the cockpit door. I found the two forward flight attendants crying, something you just do not see. I was told that after we came to a stop, every passenger on the aircraft stayed in their seats, waiting for the family to exit the aircraft.

When the family got up and gathered their things, a passenger slowly started to clap his hands. Moments later more passengers joined in and soon the entire aircraft was
clapping. Words of 'God Bless You', I'm sorry, thank you, be proud, and other kind words were uttered to the family as they made their way down the aisle and out of the airplane.

They were escorted down to the ramp to finally be with their loved one.

Many of the passengers disembarking thanked me for the announcement I had made. They were just words, I told them, I could say them over and over again, but nothing I say will bring back that brave soldier.

I respectfully ask that all of you reflect on this event and the sacrifices that millions of our men and women have made to ensure our freedom and safety in these USA, Canada, Australia New Zealand, England.
