A bikie gxxg member has had a win in a legal fight to get back cash that was seized by WA police investigating drug dealing.Police searched the car of Finks bikie gxxg member Francesco Condo in February 2009 and found two bundles of cash.
Officers seized the $90,000 saying they suspected it was the proceeds of illicit drug sales, but did not charge Mr Condo with any offence.
Mr Condo then started legal proceedings to get the money back, arguing it was the balance of a $100,000 loan to buy trucks for his family run construction business.
A District Court judge ruled that although Mr Condo had failed to prove he was the owner of the money, he was still entitled to keep $50,000 because it was legally in his possession when it was seized.
