POLICE have shut down an illicit drug ring in Toowoomba which was allegedly run by a member of the Bandidos outlaw motorcycle gang.
Anti-bikie Taskforce Hydra joined forces with local detectives during an 11-month investigation into the illegal activities of a 40-year-old Toowoomba gang member.
About 80 police officers were involved in simultaneous raids at the Bandidos club house in Civil Crt, Harlaxton and homes yesterday morning.
Police from the Special Emergency Response Team travelled from Brisbane to participate in the
raid.
The Bandidos had recently moved into their club house in a storage shed near the Deviations brothel.
Officers seized items of stolen property and, oddly, a large metal staircase during the raid.
Police have charged a 40-year-old man Newtown man, who is a member of the Bandidos Toowoomba chapter, with trafficking dangerous drugs.
A 44-year-old Rockville man was also charged with trafficking dangerous drugs. He is an associate of the Bandidos.
Taskforce Hydra officer-in-charge Garry Watts said the joint Operation Juliet Bronx closed yesterday.
"Operation Juliet Bronx was purely focused on the unlawful activities of a member of the Toowoomba chapter of the Bandidos outlaw motorcycle gang," Detective Inspector Watts said.
"This will certainly have a significant impact on the availability of illicit drugs in the Toowoomba region."
Police would not divulge what quantities of methylamphetamines were involved in the trafficking.
A small amount of illicit drugs was found during the raids.Search warrants were also executed in Warwick and Tannum Sands near Gladstone.Toowoomba Police District spokesman Darren Smith said the operation was an "outstanding success".
"Intelligence gathered as a result will assist in solving a number of serious unsolved crimes in the Toowoomba area," Detective Inspector Smith said.
The pair will appear in court today..

Germany - Berlin bans Hells Angels, raid details leaked

More than 500 police officers raided the Berlin city’s Hells Angels chapter early on Wednesday morning – in a hurried operation after police sources tipped off the gang.
The Berlin state parliament banned the “Berlin City” chapter of the gang on Tuesday evening on the grounds that members were suspected of violent crimes as well as weapons and drugs offences.
The initial plan was to carry out raids during the day on Wednesday, but this had to be pulled forward after an informer tipped off gang members, and the police moved in to hand over the official banning notice on Tuesday night.
“Unfortunately we have to assume that people from our own ranks gave information to these criminals in return for money,” a police spokesman said, adding that the betrayal was shameful for the police force.
The city's police say there are more than 1,000 biker-gang members in Berlin, of whom more than 400 belong to the Bandidos. The Frankfurter Rundschau newspaper said just over 200 Hells Angels members are known to the authorities.
Rivalry between the two gangs can often be deadly and is usually over turf disagreements concerning prostitution and drugs business – but it was reported on Wednesday that many members end up changing sides, sometimes for very pragmatic reasons.
Der Spiegel news magazine said in its online edition that the Bandidos “Southside” gang had disbanded itself ahead of an anticipated official ban, and many of the members had switched to the Hells Angels in Potsdam. They had re-registered their motorbikes and hidden some, the magazine reported.
The Berliner Morgenpost online edition even said that the Berlin Hells Angels chapter had officially disbanded in order to avoid a possible ban.
A member of the Bandidos was on Tuesday shot to death in the western state of North Rhine-Westphalia in what police believe could have been an attack by the Hells Angels.
Police carried out large-scale raids on biker gangs in northern Germany last week and police are now hunting for the body of a man they fear has been cemented into the floor of a warehouse.

TWO members of the Hells Angels bikie gang have asked NSW Police to pick up their $45,000 legal bill after extortion charges were dropped.
In Burwood Local Court yesterday, lawyers for Nonda Stamatakis and Jeffrey Sahyoun said that they should be compensated because they were prosecuted "without reasonable cause".
They argued police relied on the word of luxury car dealer Terry Mullens who they claimed was an unreliable witness.
But the police officer in charge of the case, Detective Sergeant Jonathan Woods, said the case was dropped because the key witness, Mr Mullens, was threatened on April 3.
The threats followed the firebombing of a Bentley at his Five Dock dealership.
Michael Pickin, a barrister acting for Mr Stamatakis, told the court that Mr Mullens allegedly laundered money for cocaine dealers in 2008.
He said this allegation was made by a crown witness, a convicted drug dealer, during a trial involving a cocaine shipment last year.
Mr Mullens would offer to "clean" drug money in return for a 10 per cent fee, making dirty cash look like a loan.
He did this for a drug dealer named Alberto Garza-Vasquez, who is awaiting sentence for importing 100kg of cocaine with an estimated street value of $20 million, Mr Pickin said. He said the drug dealer had gone to Mr Mullens' car dealership four times, including once with Garza-Vasquez.
Mr Mullens' car dealership was also watched by police investigating the drugs syndicate and the drug dealer told the Crime Commission that he intended to give Mr Mullens cocaine.
Mr Mullens was also convicted of fraud in 1995, the court heard.
Mr Stamatakis was charged with trying to extort $120,000 from Mr Mullens by threatening him at a meeting at a Potts Point cafe on July 8 last year, while Mr Sahyoun was charged with membership of a criminal group after attendeding Mr Mullens' car dealership when threats were allegedly made by other gang members.
Prosecutor Daniel McMahon said the Hells Angels members should not benefit because the crown witness was too afraid to give evidence. Magistrate Michael Price reserved his decision.

Police on Phuket have been warned to be wary of Bandidos bikie gang members who have been spotted on the island making visits from Pattaya and Samui.
Although many members of the Bandidos and other motorcycle gangs simply enjoy riding their vehicles, some Bandidos members have a reputation for violence and criminal activities and the gang stretches from Australia to Europe and the US.
The Deputy Superintendent of Kathu Police Station, Colonel Akanit Danpitak, told Phuketwan today that the Bandidos had caused trouble in the past and police were wary about them.
''We know in the past they have set themselves up in businesses in other parts of Thailand and the outcomes have not always been positive,'' he said.
''They tend to come into conflict eventually with other gangs and with legitimate business rivals.''
At least one Australian state has recently opted to introduce legislation designed to more closely control the activities of so-called bikie gangs.
The introduction of the legislation, opposed by civil rights activists who say the laws can be misused, follows a series of murders and violent activities, often committed in public.
The Bandidos are seen as rivals to the Hells Angels virtually everywhere, prompting a heading in an Australian newspaper earlier this month: ''Bikies waging a worldwide war.''
Fancy leather jackets, though, are not always an indication of evil intent. The Phuket riders who take part in Bike Week on Phuket each year, centring on Patong, are careful to make the distinction that those who attend are bikers, not bikies.

The Nevada hotel-casino where a brawl between rival motorcycle gangs erupted into a fatal shootout in September has a new rule for anyone attending this weekend's spring Street Vibrations rally in downtown Sparks: check your colors at the door.
Stephen Ascuaga, executive vice president at John Ascuaga's Nugget says the new rule is the direct result of last year's gun battle that claimed the life of the president of the Hells Angels chapter in San Jose, Calif.
Casino spokeswoman Beth Cooney told the Reno Gazette-Journal the ban extends to all clubs, not just those tied to gang activity.
Reno Deputy Police Chief Mike Whan said police can't enforce a colors ban but most downtown casinos there also seem to be on board with a voluntary prohibition.

The slow motion case that began with a brief and nasty brawl at the Special Memory Wedding Chapel in Las Vegas on December 20, 2008 slowed down even more last Friday.
The case has gone on for so long that the current Clark County District Attorney, Steve Wolfson, was a defense attorney when it began. He worked for a firm that represents some of the defendants and their attorneys are concerned he may have improper knowledge about their plans to contest the charges against their clients.
Wolfson has knowledge of the defenses in at least 80 ongoing cases in Las Vegas including an appeal by O.J. Simpson.
Last Friday, attorneys for some of the 13 defendants in the Wedding Chapel case asked the judge to appoint a special prosecutor. Assistant District Attorney Chris Owens, who is actually prosecuting the defendants, told Judge Michael Villani that appointing a special prosecutor would slow down the case even more and waste taxpayer’s money.

Special Memory Knife Fight

The fight spontaneously erupted after a wedding chapel manager inadvertently scheduled a Mongols wedding right after a Hells Angels wedding. The two clubs sometimes do not get along.
Two Mongols, James Nalder and Eugene Formica who were the groom and the best man, were both stabbed. A July 2010 indictment alleges they were stabbed by defendants Jeffrey Murray and John Merchant.
The bride, Amanda Valenzuela, fled the chapel and one of the defendants threw a glass bottle at her. Udell Wickham, Jonathan Babcock and James Michael Pope were also punched and kicked. The brawl lasted about one minute.
The night of the brawl, chapel owner Joshua Gust, told Las Vegas television station KTNV that the knife fight was just bad luck. “There’s 100,000 weddings a year in Las Vegas and how many across the world. To have two groups that close together, I think that is very odd.”

The Fallout

The assault led to a raid on the Hells Angels clubhouse in November 2009. Thirteen members and friends of the Hells Angels Las Vegas charter were indicted on July 8, 2010.
Together the indicted men face thirteen felony counts. The charges are: Conspiracy to Commit Assault, Battery or Provoking Commission of Breach of the Peace; two counts of Attempted Murder With Use of a Deadly Weapon With Intent to Promote the Activities of a Criminal Gang; three counts of Battery With a Deadly Weapon With Substantial Bodily Harm With Intent to Promote the Activities of a Criminal Gang; Battery With Substantial Bodily Harm With Intent to Promote the Activities of a Criminal Gang; Assault With a Deadly Weapon With Intent to Promote the Activities of a Criminal Gang; Coercion With Force; and Coercion With Force With Use of a Deadly Weapon.

A BILL
To eliminate motorcycle profiling by law enforcement
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,

SECTION 1. SHORT TITLE
This Act may be cited as the "End Motorcycle Profiling Act of 2013".

SEC. 2. DEFINITIONS
In this Act:
(1) Motorcycle Profiling.- The term "motorcycle profiling" means the
practice of a law enforcement agent or agency using the fact that a person
rides a motorcycle or wears motorcycle related paraphernalia as a factor in
deciding to stop and question, take enforcement action, arrest, or search a
person or vehicle with or without legal basis under the United States
Constitution.
(2) Law Enforcement Agent.- The term "law enforcement agent" means any
Federal, State, local, or Indian tribal official responsible for enforcing
criminal or traffic laws, including police officers and other agents of a
law enforcement agency.
(3) Law Enforcement Agency.- The term "law enforcement agency" means any
Federal, State, local, or Indian tribal public agency engaged in the
prevention, detection, or investigation of violations of criminal or traffic
laws.

(4) State.- The term "State" means each or the 50 States and the District of
Columbia.
(5) Local.- The term "local" means any city, county, township, town,
borough, village, parish or other general purpose political subdivision of a
State including any law enforcement or judicial enforcement district that is
established under State law and any Indian tribe that performs law
enforcement functions, as determined by the Secretary of the Interior.
(6) Indian Tribe.- The term "Indian tribe" has the meaning given the term in
section 102 of the Federally Recognized Indian Tribe List Act of 1994 (25
U.S.C. 479a).

TITLE I - PROHIBITION OF MOTORCYCLE PROFILING
EC. 101. PROHIBITION.
No law enforcement agent or law enforcement agency shall engage in
motorcycle profiling.
SEC. 102. (a) REMEDY.- The United States, or any individual injured by
motorcycle profiling, may enforce this title in a civil action for
declaratory or injunctive relief, filed either in a State court of general
jurisdiction or in a district court of the United States.
(b) PARTIES.- In any action brought under this title, relief may be obtained
against-
(1) Any governmental body that employed any law enforcement
agent who engaged in motorcycle profiling;
(2) any agent of such body who engaged in motorcycle profiling;
and (3) any person with supervisory authority over such agent.
(c) NATURE OF PROOF.- Proof that the routine or spontaneous law enforcement
activities of law enforcement agents in a jurisdiction have had a disparate
impact on motorcyclists shall constitute prima facia evidence of a violation
of this title.
(d) ATTORNEY'S FEES,-In any action or proceeding to enforce this title
against any governmental body, the court may allow a prevailing plaintiff,
other than the United States, reasonable attorney's fees as part of the
costs, and may include expert's fees as part of the attorney's fee.

TITLE II - DEPARTMENT OF JUSTICE
REGULATIONS AND REPORTS
SEC. 201. ATTORN EY GENERAL TO ISSUE REGULATIONS
(a) REGULATIONS.- The Attorney General shall issue such regulations as the
Attorney General determines are necessary to implement this Act.
(b) REPORTS.-
(1) IN GENERAL.- Not later than 2 years after the date of the
enactment of this Act, and annually thereafter, the Attorney General shall
submit to Congress a report on motorcycle profiling by law enforcement
agencies.
(2) SCOPE.- Each report submitted under paragraph (1) shall
include-
(A) the status of the adoption and implementation of policies
and procedures by law enforcement agencies as a result of the
regulations 3!required under section 201.
(B) a description of any other policies and procedures that
the Attorney General believes would facilitate the elimination of
motorcycle profiling.

TITLE III- MISCELLANEOUS PROVISIONS
SEC. 301. SEVERABILITY
If any such provision of this Act, or the application of such a provision to
any person or circumstance, is held to be unconstitutional, the remainder of
this Act and the application of the remaining provisions of this Act to any
person or circumstance shall not be affected thereby.
SEC. 202. SAVINGS CLAUSE.
Nothing in this Act shall be construed-
(1) to affect any Federal, State, or tribal law that applies to an
Indian tribe because of the political status of the tribe; or
(2) to waive the sovereign immunity of an Indian tribe without the
consent of the tribe.

Zamboanga City (a metropolis on the southern part of the Philippines): It seemed as though the city is under martial law, owing to the recent ordinance published in Zamboanga City after officials banned the use of full face helmets by motorcyclists, and threatened that those who would ignore the ordinance would be shot.
A big tarpaulin sign has been put up by the entrance to Barangay Lumayang, about 20 kilometers from the center off the city, that proclaims the threat.
Barangay chairman Frederick Atilano insisted that the ordinance is for the protection of the more than 1,600 residents against hired killers.
According to Atilano, just this February, Wilson Recisio, 40 years old and principal of (an unnamed) Lumayang school, was killed by "riding in tandem" motorcyclists.
"This is for our safety. Full face helmets are now banned, and those who disregard our ordinance will be shot," said Atilano.
Atilano has also requested that a checkpoint be setup in the Barangay, to make sure that no hired killers wearing full face helmets will be able to enter.

LAS VEGAS (AP) -- An attorney has filed another lawsuit challenging southern Nevada's authorities' enforcement of a state law requiring motorcyclists to wear helmets.
Travis Barrick is taking a different approach with his latest suit, three months after a similar suit he filed was tossed by a federal judge.
Last year, he sued Clark County, Las Vegas and four other cities in the county on behalf of 12 motorcyclists who thought they complied with the helmet law by wearing gear such as "skull caps" and crown-like novelty helmets.
In the latest suit, motorcyclist David Stilwell alleges three police officers in Las Vegas, North Las Vegas and Boulder City made subjective decisions when they cited him for wearing similar headgear.
The suit was filed Friday in federal court.

RYE — As the summer season heats up, and more motorcycles take to the road, Rye police joined with those from North Hampton and state troopers to take a proactive approach against illegal exhaust noise.
For three hours on Saturday, at the junction of Ocean Avenue and Causeway Road on the Rye and North Hampton border, police conducted voluntarily decibel testing on 58 motorcycles. According to New Hampshire law, the maximum emission is 106 decibels, said Rye Sgt. Scott Blaisdell.
Four motorcycles were over the legal limit and were given warnings to comply.
“One of the concerns we hear a lot is the noise of motorcycles,” Blaisdell said. “Every summer there's issues and complaints about it. We like to be ahead of it so if people do have an issue, maybe they aren't aware, and they can have it fixed.”
Ocean Avenue was packed with travellers Saturday as Memorial Day weekend was met with summer-like weather. In just a 20-minute time frame, more than a dozen motorcycles were tested and sent on their way.
“A lot of people voluntarily do this on their own to see where their bikes are at,” Blaisdell said.
He said N.H. State Police assisted Saturday with the proper equipment to conduct the testing.

The city set up a test track on the weekend to allow Calgarians to take a lap and find out exactly how noisy their vehicle is.
Animal and Bylaw Services will implement new noise technology on Friday, June 1 in an effort to reduce excessive noise pollution from vehicles.
The Noise Snare device will be strapped to a city vehicle and is designed to record video and audio of vehicles as they pass by.
A noise metre onboard the device takes a reading of the sounds from vehicles and if the reading exceeds 96 decibels, the driver could face a $200 fine.
"Its not arbitrary and making people go through a whole bunch of tests, this simply says you drove by in excess of 96 decibels, here's the proof and here's the ticket," said Bill Bruce, Director of Animal and Bylaw Services for the city.
The city set up a track at the Emergency Vehicle Training Track behind the Fire Department Training Academy at 5811 - 23 Ave. S.E. on Saturday and dozens of motorists took part in the tests.
The owner of Kane's Harley-Davidson Calgary says motorcycles shouldn't be the only target of the new limits.
"Big trucks and their tire noise is noisier than most motorcycles, when we did some testing we had a school bus that was a hundred and three. A school bus," said Mick Cawthorne from Kane's.
Rider, Lance Doonan says he believes louder bikes are safer.
"You are just a thin little pencil line in someone's rearview mirror and so often people don't look, But if they hear ya then they look," said Doonan.
The excessive vehicle noise provision was added to the Calgary Traffic Bylaw last year.
During the first month of deployment, the city will hand out warnings.

NEW ZEALAND - Drug charges against Head Hunters dropped

Seven high-ranking members of the Head Hunters have had charges relating to a million dollars' worth of methamphetamine dropped.
Cain McFarland, Cristopher Morris, Anthony Neho, Christopher Williams, Lee Bell, Mark Barnes, Nathan Hemana and Craig Paterson were facing charges of belonging to an organised criminal group and posession of more than 1kg of methamphetamine for supply.
Justice Tim Brewer discharged the men at the High Court at Auckland this morning.
Bryan Collett and Phillip Robarts are also to have their charges dropped but were not in court this morning.
However, the president of the motorcycle gang - David James Dunn - still faces charges relating to the drugs. He will stand trial in November.
The men were arrested in March last year after police raided the gxxg's headquarters in Henderson, Auckland.
More than 1kg of methamphetamine, valued at more than $1 million, was found in the clubrooms.

The Feds have been forced to release their social network monitoring manual, which contains the list of words the government watches on social media and news sites.
Earlier the Huffington Post reported on the Feds have been forced to give up their list of words they monitor on Facebook, Twitter, and comments being posted on news articles so I compiled that list below.

Ever complain on Facebook that you were feeling “sick?” Told your friends to “watch” a certain TV show? Left a comment on a media website about government “pork?”

If you did any of those things, or tweeted about your recent vacation in “Mexico” or a shopping trip to “Target,” the Department of Homeland Security may have noticed.

In the latest revelation of how the federal government is monitoring social media and online news outlets, the Electronic Privacy Information Center has posted online a 2011 Department of Homeland Security manual that includes hundreds of key words (such as those above) and search terms used to detect possible terrorism, unfolding natural disasters and public health threats. The center, a privacy watchdog group, filed a Freedom of Information Act request and then sued to obtain the release of the documents.
The 39-page “Analyst’s Desktop Binder” used by the department’s National Operations Center includes no-brainer words like “”attack,” “epidemic” and “Al Qaeda” (with various spellings). But the list also includes words that can be interpreted as either menacing or innocent depending on the context, such as “exercise,” “drill,” “wave,” “initiative,” “relief” and “organization.”

These terms and others are “broad, vague and ambiguous” and include “vast amounts of First Amendment protected speech that is entirely unrelated to the Department of Homeland Security mission to protect the public against terrorism and disasters,” stated the Electronic Privacy Information Center in letter to the House Homeland Security Subcommittee on Counterterrorism and Intelligence.

The manual was released by the center a week after Homeland Security officials were grilled at a House hearing over other documents obtained through a Freedom of Information Act lawsuit that revealed analysts were scrutinizing online comments that “reflect adversely” on the federal government. Mary Ellen Callahan, the chief privacy officer for the Department of Homeland Security, and Richard Chavez, director for the National Operations Center, testified that the released documents were outdated and that social media was monitored strictly to provide situational awareness and not to police disparaging opinions about the federal government. On Friday, Homeland Security officials stuck by that testimony.

A senior Homeland Security official who spoke to The Huffington Post on Friday on condition of anonymity said the testimony of agency officials last week remains “accurate” and the manual “is a starting point, not the endgame” in maintaining situational awareness of natural and man-made threats. The official denied Electronic Privacy Information Center’s charge that the government is monitoring dissent. The manual’s instruction that analysts should identify “media reports that reflect adversely on DHS and response activities” was not aimed at silencing criticism but at spotting and addressing problems, she added.

History students, up through college, are commonly taught that the Viking raids in medieval Europe were so ferocious that priests invented a Latin prayer: A furore Normannorum libera nos, Domine, or in English, “Deliver us from the fury of the Northmen, dear God.” Educated people, particularly school teachers, routinely instruct students that the prayer was a fact. And of course it wasn’t.
There was no common prayer for deliverance from the Vikings. The prayer was invented at least a century after the violence ended. It was a way of describing how bad the Vikings raids must have been. And, right now something like that is happening to the Vagos, who wear a Norse god on their backs, and who must be a far greater threat to America and the world than their actual numbers would suggest.
One of Fox Television’s premier infotainment franchises, television station KTTV in Los Angeles, ran another “report” about the fury of the Vagos over the holiday weekend. This one, reported by a Peabody Award winner named Chris Blatchford, was titled “The Green Nation is On a Mission to Replace the Hells Angels Biker Gang.” It sounded more like an opening argument than a report.

Background

Blatchford’s journalism recapitulates the bare facts of, and the ATF interpretation of, several violent episodes between the Vagos and the Hells Angels Motorcycle Club in the last three years. Blatchford leads with the shootout in Sparks, Nevada last fall; follows with the brawl at Lazy Harry’s Sunshine Saloon in Bullhead City, Arizona in June 2009; and also mentions the gun battle between Vagos and Angels in Chino Valley, Arizona in August 2010. The incidents are sensational and amazing to people who worry all the time or who wish they were as dangerous as outlaw bikers whenever they are confronted by the frequent, petty humiliations of modern American life.
Fox in Los Angeles ran the two part series because those frightened and angry people are as fascinated by the violence that boils out of the outlaw world as they are by naked women. Fox went with the Vagos piece because the station might get in trouble if it encouraged its female “reporters” to actually strip. And, because the Federal Communications Commission doesn’t give a damn about lousy reporting.
Blatchford’s sources included the professional biker expert Jorge Gil Blanco. In recent years years, Gil Blanco has testified against the late Hells Angel Mark Guardado and against the combatants in Bullhead City. He was the go to source for most reporters after the Sparks shootout. Like most biker experts he is a nitwit. He tells Blatchford that all the friction between the two motorcycle clubs is the result of the Vagos recent growth and that the green motorcycle club is growing “exponentially.”
Blatchford also quotes, without attribution, Lake County, California Sheriff Frank Rivero. Rivero is also famous for being less bright than average. He started a panic last year when the Vagos had a party. Rivero imagined a great horde of Hells Angels must be coming to spoil that party and he mobilized an army of police to locate, engage and neutralize that phantom menace.

Quick Draw

Blatchford’s primary source is a former Vagos infiltrator named Charles “Quickdraw” Falco. Falco is the subject of outlaw biker authority Kerrie Droban’s next book titled Inside Out: My Life Undercover with the Vagos. Falco loathes the Vagos but not enough to remove his Vagos cut during television interviews.
He tells the world that the Vagos and the Angels are engaged in a “gang war” that resulted from the Vagos expansion into Arizona. “This is a real war that will never end,” he says.
“Quick draw says,” Blatchford reports, “it was that 2010 shootout that raised the stakes.”
“Now it’s life or death to them,” Falco explains. “All these gangs want to grow and spread and be the biggest gang in the valley…. Their goal is to be the biggest and the baddest.”
A Vegas “biker cop” named John Wooston adds that he is worried about the Vagos “war” with the Angels in California and Nevada because, “You’re talking about gang members who in some cases may be sociopaths, criminals, alpha dogs…. Any history they have whether it is in California, Arizona or anywhere else across the country will carry over here.”

Support Your Local Biker Expert

Then Falco explains why all frightened and angry Americans should support the outlaw biker experts’ holy work. “I predict within the next five years they will be the biggest biker gang in America.”
Blatchford punctuates his long piece by confiding, “An old time Vago biker tells us what’s going to feed and fuel Vago growth is even more blood.”
So forget about unemployment, the foreclosure crisis, the student loan crisis and all the other features of America’s economic recovery. Forget that. All that is nothing. What we really need to do is support the ATF and the FBI in their covert war to save us from the fury of the Vagos. Major market television has already begun to report how bad the Vagos must be.
And, there is probably a federal grand jury in Los Angeles considering the “exponentially” growing Vagos problem right now. What do you think the odds are that prosecutors already know that most of those jurors know the world mostly from what they see on Fox?

National Motorcycle Profiling Act has been Drafted

A National Motorcycling Profiling Act has been drafted!

At the NCOM Convention in Indy a couple of weeks ago, Double D, outlined what he and others envisioned for a National Motorcycle Profiling Act.  Double D is a member of the Outsiders MC Tacoma, US Defenders National Legislative Liaison and Washington State Commander, Washington State COC Spokesperson, plus a member of the NCOM Legislative Task Force.  Doesn’t that just make you tired reading all he does!

I have had the pleasure of meeting Double D several times as well as listen to him speak.  He is very, very energetic and inspiring.  He and his team in Washington were able to make profiling motorcycle riders illegal, plus requiring the education of the police on what they can and cannot do when dealing with a motorcycle rider.  It’s the first in the United States, I believe, and I hope not the last.  But if they can pass a National Motorcycle Profiling Act, it should cover a large portion of the motorcycle community.

As a starting point they have established “The End Motorcycle Profiling Committee” made up of individuals with specific duties including policy, communications, media, networking, just to name a few items. This committee is headed up by Double D and the committee will provide the direction and access to the tools required to achieve success by working within as many organizations as possible and getting on the same page.  ABATE will be one of those group and we will keep you posted as this progresses.

If you watch the video's you can clearly see the difference between somone who understands some of their rights, and someone who does not.
In recent newsletters we’ve offered tips on how to handle yourself in some very specific and potentially perilous roadside situations (recording police during traffic stops and what to do if asked for a DNA sample). Running throughout is the theme that motorists need to know and assert their civil rights in order to protect themselves from potential abuses by law enforcement.

A recent decision by the Delaware Supreme Court highlights how important this is. The court ruled that police cannot unduly detain a motorist pulled over for a routine violation in order to conduct a more extensive investigation into another crime. “An officer who pulls a car over for speeding does not thereby gain free rein to ask as many questions, for as long a time, as he might wish,” the court’s ruling stated. “Further investigation requires further justification.”

The court went on to state that once the officers concluded their investigation of the initial alleged traffic violation, they had no authority to continue detaining the car and no reason to suspect the driver of additional crimes.

Nonetheless, if the driver had known he was free to leave at this stage, he could have saved himself from a lengthy legal battle. He could have exercised his rights with these six simple words: “Am I free to go now?” But he didn’t, and the officers kept pushing until they found evidence of another crime—evidence that the Delaware Supreme Court ruled inadmissible because of how it was obtained.

The phrase, “Am I free to go now?” should find its way into nearly any roadside interaction you have with police. If you choose to answer questions at a traffic stop (be careful when doing so), one strategy is to end every answer with “Am I free to go now?” It’s an assertion of your rights, and it may prevent a routine stop from escalating into a more serious situation.

The video below shows what can go wrong when a motorist doesn’t assert his rights. The officer stopped the car on the flimsiest of pretenses and proceeded to manipulate the driver into consenting to a full-on vehicle search complete with a “drug-sniffing” dog.

How many times could the driver have said “Am I free to go now?” and potentially extricated himself and his passenger from this harrowing experience?

Note also how the officer tried to manufacture reasonable suspicion by claiming the passenger appeared nervous—a ploy likewise repudiated by the Delaware decision. The whole dynamic is reminiscent of a used car salesman manipulating a buyer into a bad deal.

Now watch this video in which a motorist challenges U.S. Border Patrol officers at an immigration checkpoint in Arizona. His choice of phrases differs slightly, but the intent is the same. Notice that he does not get distracted by the officer asking him questions. He stays on task and accomplishes his objective: getting through a roadblock without undue harassment.

To carry the salesperson analogy a little further, this driver asserted control over the transaction and never relinquished it. And he prevailed. If you go this route, remember to remain calm and don't provoke the officer.
