Why the Bikers of America Cannot Continue to be Ignored or Forgotten


I’ve held the position of Vice-President of Government Affairs for the Motorcycle Riders Foundation for roughly 18 months. And during those months I’ve sat in countless meetings, congressional hearings, public information sessions, symposiums, conferences and breakout sessions which have covered a gamut of issues that affect riders. Anything and everything from ethanol to self-driving cars to road design and infrastructure, I’ve sat, listened and taken detailed notes. However, during the last couple of months I’ve started to uncover
a deeper (and darker) underlying message in my meetings. I’m not one for conspiracy theories so I won’t suggest that my theory is the product of some sort of anti-motorcycle secret society, but what I am beginning to believe is that the future of riders – our future – is questionable.
I say this because as I’ve sat through these meetings and conference calls, my takeaway increasingly becomes that the U.S. population at large, just doesn’t give a shit about motorcycles. We’re ignored or perhaps forgotten. We’re relegated to the category of recreation. And dangerous recreation at that. We’re swept into the same column as shark cage diving, or bull running or cliff base jumping. And though I have no problem with any of those recreational activities, riding motorcycles is not the same. It’s not even CLOSE to the same! Though many of us ride for the fun and the thrill of it, our bikes also get us from place to place. Unlike swimming with the sharks or running with the bulls, riding a motorcycle is a form of transportation. Motorcycles get us to work, to the post office, to the dentist. So why, in America of all places, are we forced to say again and again and again, what about us?
There is surprisingly little research done about the benefits of riding motorcycles. And I am not talking about benefits to the rider. You ask any one of our MRF members and they’ll tell you that riding is cheaper than seeing a psychiatrist. So lets put that aside for a minute and talk about the benefits to society. In Europe several years ago, there was a study done to test mobility – that is moving from point A to point B. They looked at commuting routes from outside major cities and within major cities as well as rural areas over varying distances and compared the mobility of a motorcycle to that of a car. And out of the fourteen tests they conducted to measure mobility, the motorcycle won 85% of the time. So in other words, a motorcycle is more likely to get you to your destination faster (and not just because you’re speeding).
The impacts go on from there. Another study (also in Europe where motorcycles are better viewed and accepted as a legitimate form of transportation) showed the impact of what might happen if just 10% of cars were replaced by motorcycles. Time loss for all vehicles would decrease by 40%. That means a quicker commute for everyone whether they are on a motorcycle or not. And with less cars on the road and less sitting in traffic, that means an impact on emissions. Though I have not uncovered a comprehensive study on the specific issue of reduced emissions and motorcycle usage, a case study by Transport & Mobility Leuven (yep, Europe again) stated that, “New motorcycles emit fewer pollutants compared to average privat
e cars (less NOX, NO2, PM2.5 and EC, but more VOC). They also emit less CO2. Total external emission costs of new motorcycles are more than 20% lower than average private cars. On the section of motorway between Leuven and Brussels, total emission costs can be reduced by 6% if 10% of private cars are replaced by motorcycles.”
There are other benefits too. Things like fuel efficiency; most bikes get as many miles per gallon as a car if not much more. What about infrastructure? Right now, the Trump Administration is currently figuring out how to raise $200 billion to upgrade our nation’s infrastructure which is in dire shape in some parts of the country. What
may have helped our nations’ crumbing infrastructure? A motorcycle’s lighter touch could mean less wear and tear on a bridge or a road than a heavier, wider-set vehicle.
Given all the aforementioned benefits, you’d think I’d hear some praise from non-riders. Instead, I hear a lot about noise pollution. And that’s when they even talk about motorcycles. In many cases, they aren’t. Take the National Highway Traffic Safety Administration (NHTSA); when they put out their initial guidance on autonomous vehicles and potential policies and safety factors, motorcycles weren’t even mentioned. They revised the document a year later, and though they did mention motorcycles, it was in the context of what vehicles NHTSA has jurisdiction over. Where it was blindingly not was in the section that has to do with the ability of this technology to identify and respond to objects on the road. Interestingly, the guidance names cars, trucks, pedestrians, bicyclists and animals. But not motorcycles. 
Another instance of riders being forgotten (or ignored)? The newly minted U.S. version of Vision Zero, called Road to Zero. It’s a program with an admirable goal – to completely eliminate deaths on our nation’s highways in 20 years. The program spends very little time or resources on motorcycle and related issues in every meeting I’ve attended. Even the logo can’t be bothered to contain a motorcycle rider.
It is estimated that there are more than 300 million powered two-wheelers in the world. These are substantial numbers, so when it comes being viewed as a legitimate form of transportation, why are riders having to fight for a seat at the table? And an even bigger question is how we can change this dynamic? I don’t have the answers, but I bet if enough of us put our heads together we can start to chip away at the problem targeting not just society as a whole, but the different segments that contribute to this pervasive problem. From policymakers to media to public interest groups and everyone in between, we need to make sure that riders everywhere, regardless of what patch you hold or bike you ride, deliver the message that motorcycles have a place in the future.

As many as 15 states in the country now have enacted laws that allow motorcyclists to run red lights.
What this means is that motorcyclists in these states can now cross an intersection even when the light is red, and not be charged with anything.
Currently, Arkansas, Idaho, Illinois, Minnesota, Missouri, Nevada, North Carolina, Oklahoma, South Carolina, Tennessee, Virginia, and Wisconsin have such laws. 4 years ago, Nebraska had also proposed a similar bill, but it hasn’t been enacted yet. The status is currently, “indefinitely postponed”.
It may sound bizarre to many readers how motorcyclists can be given such an exception, especially those not outside the US. However, there’s good reason for that. Most traffic lights in these states only go green for a particular lane only when a vehicle on it has been waiting to cross an intersection.
The system uses metal sensors to detect if a vehicle is waiting. However, these sensors are not always very sensitive.
As a result, vehicles like motorcycles and bicycles are often not able to trigger these sensors due to the low volume of metal they have. Consequently, the riders are left with rather impractical options to cross such an intersection.
Either they get off their vehicle and trip the pedestrian crosswalk button, or ask for cars to squeeze through their lane, or simply run the light.
These states recognized this plight of the riders, and officially made it legal to run such lights.
However, most of these states have guidelines in place to prevent misuse. The riders are required to come to a complete stop at such lights, and then proceed into the intersection only when there’s no incoming traffic or pedestrians.
Consequently, the liability in case of an accident at the intersection while a rider is running a red light has been shifted to the rider.


Here are the details about it:

Arkansas – In effect since 2005, state law allows a motorcyclist to proceed with caution, after coming to a full and complete stop, through a red light that fails to detect the bike. (Arkansas Code section 27-52-206)

Idaho – (2006) If a signal fails to operate after one cycle of the traffic light that a motorcyclist may proceed, using due caution and care, after coming to a full and complete stop at the intersection. (Statute 49-802)

Illinois – (2012) Permits a driver of a motorcycles or bicycle facing a red light that fails to change within a reasonable period of time of not less than 120 seconds to proceed after yielding the right-of-way to any oncoming traffic. However, this law doesn’t apply to municipalities of over 2,000,000 people – such as Chicago. (625 ILCS 5/11-306)

Minnesota – (2002) A person operating a bicycle or motorcycle who runs a red light has an affirmative defense if the driver first came to a complete stop, the traffic light stayed red for an unreasonable amount of time and appeared not to detect the vehicle and no motor vehicles or people were approaching the street. (Statute 169.06)

Missouri – (2009) State law tells both motorcyclists and bicyclists that run red lights that they have an affirmative defense if they brought their vehicle to a complete stop, the light was red for an unreasonable time period, and there were no motor vehicle or person approaching. (Statute 304.285)

Nevada – (2013) Those using motorcycles, bicycles, mopeds, and tri-mobiles are allowed to proceed through an intersection with a red light after waiting for two traffic light cycles, and they yield to other vehicle traffic or pedestrians. (Statute 484B.307)

North Carolina – (2007) Motorcyclists are permitted to move cautiously through a steady red light after coming to a complete stop and waiting a minimum of three minutes and if no other vehicle or pedestrians are approaching the intersection. (NCGS 20-158)

Oklahoma – (2010) Motorcycles can proceed cautiously through a steady red light intersection after a making a complete stop and if no other motor vehicle or person is approaching the roadway. (Statute 47-11-202)

South Carolina – (2008) After making a complete stop and waiting for a minimum of 120 seconds, the driver of a motorcycle, moped, or bicycle may treat a steady red light that doesn’t change as a stop sign and proceed with caution. (S.C. Code 56-5-970)

Tennessee – (2003) After coming to a complete stop, motorcyclists and bicyclists may proceed through a steady red light when it is safe to do so. (Tennessee Traffic Control Signals 55-8-110)

Virginia – (2011) Drivers of motorcycles, mopeds, and bicycles may move with caution through non-responsive red lights as long as they yield the right-of-way to others approaching the intersection, and have come to a complete stop for two complete light cycles or 120 seconds, whichever is shorter.(Statute 46-2-833)

Wisconsin – (2006) A motorcycle, moped or bicycle is permitted to run a steady red light after making a complete stop and waiting at least 45 seconds and then yields the right–of-way to any vehicular traffic or pedestrians using the intersection. (Statute 346.37)

Washington – (2015) During the last legislative session, a new section was added to Chapter 46.61 RCW in Washington State that allows the operator of a street legal motorcycle to make a left turn, after stopping at an intersection that is controlled by a triggered traffic control signal, if the device fails to operate after one cycle of the traffic signal. (Amendment to Chapter 46.61 RCW)

Kentucky – (2015) Motorcyclists must come to a complete stop, wait for at least two minutes or two light cycles and make sure no other vehicles are crossing the intersection before proceeding. (HB 370)

Kansas – (2012) Motorcycles may proceed at a non-responsive red light when safe and after a reasonable amount of time. (KS Statutes, Chapter 8, Article 15, Section 8, C4)

Bill to amend vehicle Code section 40302 providing that a person who is lawfully detained must present their face as part of the identification process. Refusing to show the driver's face to law enforcement today, is not illegal; there is no requirement in law for example that a motorcycle rider to remove their helmet during a traffic stop.

The idea for the law, which is primarily targeted at helmeted motorcyclists, came from a Simi Valley patrol officer (Coulter).

CA - Mongols Nation Case Dances On Pin

The Mongols Nation case, United States versus Mongol Nation: An Unincorporated Association, is scheduled for trial June 26 before District Judge David O. Carter in the Ronald Reagan Federal Courthouse in Santa Ana, California June 26.

This case is about authorizing police to rip the patches off motorcycle club members’ backs and it began, in what most human beings consider to be consensual reality, “in or about June, 2005” when an ATF Case Agent named John Ciccone convinced a member of the Mongols Camarillo chapter named T.J. Stansbury, who had been caught selling steroids by mail, to inform on his club brothers and introduce ATF undercover agents into the club. The case eventually got the public relations name “Operation Black Rain.” The investigation abruptly ended in October 2008, simultaneously with the murder of a Mongol named Manuel Vincent “Hitman” Martin. Then the investigation became a racketeering case titled U.S. v. Cavazos et al. It was named for the former Mongols president who had already been expelled from the club before the indictment was unsealed.

The Cavazos case was not cost efficient or even particularly successful. Ruben “Doc” Cavazos, for whom the case was named, had more or less promised the government the Mongols name and insignia on a silver platter. Unfortunately for the government big brains who prosecuted Cavazos, that turned out to be unconstitutional and Doc Cavazos was sentenced, in a secret hearing in a closed court, to 14 years in prison. Witnesses would later say that Ciccone laughed at him.
Mulligan

Eventually, the federal judge who sentenced Cavazos, Otis D. Wright II – who identified with prosecutors more strongly than with defendants – decided to give the Cavazos prosecutors a Mulligan. Following Wright’s legal instructions to a tee, the Cavazos prosecutors filed the Mongols Nation case in 2013. Wright presided over the case with an unethically heavy hand until he realized that his antics might attract the notice of the national press. On the eve of trial, he recused himself. After a misstep or two the case landed in Judge Carter’s court for reasons you don’t care about and that would only require more words to explain. (You have already had to read 325 words just to get this far into this preface – which is the reason why this prosecution ceased to be a national story long ago. Three hundred twenty-five words is, like, six normal television stories.)

To try to make a long story shorter, Carter dismissed the case on highly technical grounds – which is: “the distinction between RICO persons and RICO enterprises.” Judge Carter thought, in a decision loaded with Venn diagrams, that the government failed to make that distinction. The government appealed to the Ninth Circuit. Appeals judges love things like purely symbolic representations of legal truths, so the appeals judges overruled Carter’s dismissal.

Now, here we all are, a mere 13 years into the case. There will probably be a trial. It will probably be a jury trial, and so no one is shocked or surprised, the author of this page, Donald Charles Davis, is a consultant in the case for the defense and will probably testify for the defense at trial. If there is a trial.
But First

First the lawyers have to get through a motion hearing scheduled for May 21. So far the Mongols lawyer, Joe Yanny, has filed six motions.

One asks the court to separate the penalty phase of the trial from the issue of whether Mongols Nation is guilty of racketeering. The whole point of this case has always been to seize control of the Mongols name and insignia by way of civil forfeiture. The government thinks Yanny;s motion should “be denied.”

Another motion asks that the government to “discover” (which is lawyer talk for “stop hiding”) the evidence in its possession to the defense. The government’s reply to that is, ‘How do you know we are hiding evidence? What makes you think we haven’t given you everything? Are you saying we have a leak! Leakers should be prosecuted! Why isn’t the FBI looking into this leaker problem!?!”

Another motion asks the government to limit expert testimony. It is customary to fill motorcycle club trials with the testimony of police experts. In this case, some of those experts will probably be the same undercover ATF agents who investigated the Mongols during Operation Black Rain. One of those agents, Darrin Kozlowski, testified at the trial of Bandido Jake Carrizal last fall in Waco. Kozlowski lied during his testimony. The government, of course, objects to the defense motion.

The defense also wants Carter to forbid the prosecution from introducing evidence of what lawyers call Malum In Se crimes, which are crimes that are inherently evil like murder as opposed to crimes that merely violate some law, like the law against smoking marijuana. And Yanny wants to prohibit prejudicial statements and testimony by the prosecutors – things like the word “gang” or what red wings mean.
And Now This

But the most important of these pretrial motions so far is one that asks the court to “bifurcate the issue of whether the Mongols MC…is a legally distinct entity from the Defendant, Mongols Nation.” It is the key issue in the case and, because it is obtuse, it inoculates this case against national press coverage.

The RICO statute, which has drifted far from its original harbor, prohibits “any person employed by or associated with any enterprise” from “participating…in the conduct of such enterprise’s affairs through a pattern of racketeering activity.” Case law has interpreted that part of the statute to mean that the RICO “person” must be distinct from the RICO “enterprise. The RICO person is the named defendant while the RICO enterprise can be either a legal entity or an association-in-fact.

In this case, the government didn’t try to prosecute the Mongols Motorcycle Club. Instead, prosecutors invented a “person” named Mongol Nation because that was what Judge Wright told them to do when he sowed the wind.

In its reply to Yanny’s motion, the government argues: “In Cedric Kushner Promotions, Ltd.v.. King, the Supreme Court held that ‘to establish liability…one must allege and prove the existence of two distinct entities: (1) a ‘person’; and (2) an ‘enterprise’ that is not simply the same ‘person’ referred to by a different name. Cedric Kushner stands for the proposition that the distinctiveness requirement is satisfied by ‘practical separateness,’ a determination that will obviously and necessarily depend upon the government’s evidence presented at trial.”

“Defendant concedes, as it must, that the appellate court’s holding established that the government properly alleged distinctiveness in the indictment. The argument defendant appears to be making – that is, that the issue of distinctiveness can be determined as an ‘independent issue’ apart from the ultimate issues relating to criminal culpability – is devoid of both substance and logic.”

Got that? That’s okay. Nobody else gets it either.

The government’s prose does not exactly sing. Its argument is medieval rather than compelling. The point of all this twisted logic seems to be to have Ciccone and Kozlowski tell a jury war stories for a couple of weeks and then let the jurors decide whether the Mongols Nation and the Mongols Motorcycle Club are legally distinct from each other or not.

People who care about legal technicalities will find out whether Judge Carter is going to let the government get away with that late next month. No doubt they await his decision as children anticipate the coming of the Easter Bunny. Everybody else stopped reading this 800 words ago.
