The National Firearms Act, Gun Control Act and other laws have been ratified by Congress to support the right to have arms, which is a human right according to the U.S. Constitution. However, penalities for carrying a gun with no license are dependent on several factors.
  1. Different State Laws

    • Each state controls their own firearm legislation. In Arizona for example you can carry a concealed gun without a permit but in Michigan you will need to be over 21 and have a permit. Therefore the consequences of being caught without a license or permit will depend on where you live.

    Outcomes

    • If it is illegal for you to carry a gun without a license, depending on your state the following will occur:
      1. The gun will be confiscated.
      2. You will questioned regarding why, how and what you are doing with a gun.
      3. You may have to attend a court hearing or a fine will be issued.

    Maximum Penalities

    • A $10,000 fine and a maximum sentence of up to five years are enforceable in some states. Depending on the severity of your case, the penalties will vary. For example, the type of gun you were carrying or your age will affect the judge's order.
