FONTANA, CA - Gang leader convicted of murder seeks new trial

The sentencing of a former chapter president of the Vagos motorcycle club, Keith Allen Silva, convicted in December of killing Dennis Daoussis, was delayed Friday so his attorney could work on a motion for a new trial.
Silva's lawyer, Stuart O'Melveny, requested transcripts of his client's trial at a conference with Deputy District Attorney John Thomas and Judge Ingrid Uhler in her chambers, Uhler announced in court.
The trial transcripts, contained in 11 volumes, are sought by O'Melveny to prepare the motion. The basis for the motion was not revealed.
Silva returns to court Oct. 14 to argue the motion. If it is denied, Silva could be sentenced that day, the court said.
Thomas had no comment about the court proceedings Friday.
Silva, 47, and David Anthony Beltran, 36, were found guilty on Dec. 7 of killing the 34-year-old Daoussis, who was beaten at a Fontana home in April 2003, bound with zip ties and duct tape, and then driven by pickup truck to Landers.
Silva, who was president of the Berdoo Chapter of the Vagos at the time, and Beltran, who was sergeant at arms of the Inland Empire Chapter, were found guilty of first-degree murder, torture and various special allegations which include the use of a weapon and committing a crime to benefit a gang, according to court records.
Silva admitted to having a prior strike. He faces about 95 to 105 years to life in state prison, according to prosecutors.
The victim's death was centered around an unpaid debt to a Vagos member who entrusted Daoussis with $3,000 to buy a motorcycle, say prosecutors. Sheriff's detectives say that member never received the motorcycle, and he wasn't given his money back.
Prosecutors say Silva and Beltran drove the victim to Landers. An ATV rider found Daoussis' body, with a gunshot to the left temple, on April 5, 2003, on Ming Road.
Beltran was sentenced on May 6 to 50 years to life in state prison, according to court records.
O'Melveny, who represents Silva for the new trial motion, did not return a phone call for comment. The trial lawyer was Dan Faulhaber.
