A former Knoxville police officer convicted of plying two underage girls with alcohol wants a chance for a clean record.
Donald Scott Clark pleaded guilty Friday to two misdemeanor charges of providing alcohol to minors. He'll serve a suspended one-year sentence, pay a $250 fine and complete 200 hours of community service, prosecutors said.
Clark must also surrender his certification as a police officer and avoid contact with children as part of the plea agreement.
"Do you understand what you're agreeing to today?" Knox County Criminal Court Judge Bob McGee asked.
"Yes, sir, I do," Clark said.
Clark asked for judicial diversion, which would allow him to have his record wiped clean at the end of his probation. Prosecutors said they'll oppose that move.
The judge said he'll make a decision on Clark's request at a hearing March 31.
"Mr. Clark is pleased that he was able to resolve this today," said his lawyer, Gregory P. Isaacs. "He's accepted responsibility for this incident and looks forward to closure and moving on with his life. Mr. Clark has no criminal record whatsoever. He was an excellent officer with the Knoxville Police Department. He made one mistake."
Assistant District Attorney General Steve Sword said Clark's mistakes stretched from May 1, 2009, to July 3, 2009, when Clark and fellow KPD officer Nicky Ray Bryant resigned after accusations that they showed a pair of 13-year-old girls bondage pornography, gave them alcohol and enticed the girls to dance and do a partial striptease. Clark had served as an officer since 2004 and Bryant since 2002.
Prosecutors filed no sex-crime charges in the case and ultimately dropped two charges against Clark of contributing to the delinquency of minors.
Bryant faces the same charges as Clark, along with a felony charge of sexual exploitation of a minor. That charge came after Knox County Sheriff's Office deputies seized a computer from Bryant's home last April that deputies said he used to download child pornography.
Isaacs wouldn't say whether Clark cooperated in the case against Bryant.
Bryant appeared in court Friday but didn't enter a plea. He and Clark sat on opposite sides of the courtroom. Bryant's lawyer, Jeff Whitt, told the judge he expects to work out a plea in the case.
"We certainly anticipate asking for judicial diversion as well," Whitt said.
Bryant will return to court March 31, the same date as Clark's diversion hearing.
