Yavapai County, AZ - Judge sets next hearing for men associated with Vagos in Chino Valley shooting

Yavapai County Superior Court Judge Ralph M. Hess heard a request Monday morning from lawyers for two men affiliated with the Vagos motorcycle gang to respond to their motion to send their cases back to the grand jury.
Jess Ramirez Flores, 61, of Glendale, is charged with discharging a firearm, possession of narcotic drugs, and possession of dangerous drugs in connection with the shooting between the Vagos and Hells Angels motorcycle gangs in an unincorporated area northwest of Chino Valley on Aug. 21. Apfel, 38, of Las Vegas, is charged with discharging a firearm at a residential structure in the same incident.
Apfel's attorney, Craig Williams, told Hess that he filed a motion in October to remand the case back to the grand jury and that Flores' attorney, David Shapiro, joined that motion soon after.
"I'd ask for the court to rule on it so we can move forward one way or the other," Williams said.
Williams and Shapiro filed motions challenging the grand jury proceeding, saying their clients were denied a substantial procedural right.
Deputy County Attorney Dana Owens asked Hess to "set a time limit and we'll know how to plan and proceed."
Hess said "I'll see it gets prompt attention." Then Hess set a case management conference for 9 a.m. March 14 in Division 6.
In a request filed Dec. 2, Williams had asked for a hearing on their motion to remand, which was withdrawn at Monday's hearing when Williams requested a ruling on the motion instead.
In a motion filed Dec. 1, Shapiro noted that a letter from Flores' doctor and a prescription Flores had for the drug was not presented to the grand jury and Shapiro requested those charges be dismissed.
