Online PR News – 17-January-2011 –Colorado Springs : - McDowell Laybourne & Rodemer, a well-established Colorado Law Firm, has announced that it is supporting the recent legal development in Colorado laws; Colorado lawmakers considered legal limit for Marijuana use in DUI cases. Since the firm is specialist in Colorado laws, it is taking special notice of this news, recently reported in the Denver Post. It is one of the most reputable law firms of Colorado that offers its legal expertise to people in different cases. They represent the cases of criminal defense, personal injury, accident victims, Drunk Driving (DUI/DWAI) matters, Car Accidents, Motorcycle Accidents, Pedestrian/Car accidents, Premises Liability and Insurance Claims.

Commenting on this important news, Joshua Mcdowell, the founder of this Colorado Law firm and a Colorado DUI attorney said, “Since we are known for our experience and expertise in DUI cases, this news holds special importance for us. To make the DUI laws more stringent, Colorado Lawmakers are considering adding a certain level of marijuana in the user system to find out the impairment while operating motor vehicles. According to current Colorado laws, in DUI cases, a Colorado DUI Attorney cannot establish impairment due to a certain amount of marijuana, although they can mention the usage of a drug or alcohol making the person, physically or mentally or both, incapable of safe driving at the moment of accident. However, if Colorado laws include what is suggested by Colorado lawmakers, it would be very helpful to a Colorado DUI attorney to establish the degree of incapability in the accused.”

The Colorado State Legislature has set a particular limit for BAC (Blood alcohol Content) for the drivers driving under the influence (DUI) or impaired by alcohol or marijuana. The statute allows for permissible inference that if the BAC is above a 0.08, the person was “driving under the influence”. With this proposed legal law, the State legislature is considering to introduce a new measure that would help establish the level of impairment caused by certain amount of marijuana and other drugs in the blood of the person. It will support DUID/DWAID charge.

Adding further, Mr. Joshua Mcdowell said, “Once this proposal becomes a law, it would help Colorado DUI Attorney to establish the DUI charges. It will make things clear that whether the person is impaired under the influence of drug or not. Currently there is no set limit for marijuana that can be considered to establish the DUI charges. Even people with considerable amount of drugs in their blood escape the charges if they become successful in proving their innocence. It causes great loss to the real victims because they are not able to get sufficient claim for their harm.”
