Province reworks gang colour law after court loss to Hells Angel`s...
REGINA - The Saskatchewan government is trying to fix a law that was intended to stop people from wearing gang colours in bars, but failed.
Public Safety Minister Yogi Huyghebaert has introduced changes to tighten the Safer Communities and Neighbourhoods Act so it will stand up to constitutional challenges.
The law was successfully challenged by a member of the Hells Angels who was charged in 2007 for wearing his gang colours in a Saskatoon bar.
The judge on the case ruled that the law violates a person's right to freedom of expression, adding it was too broad in some areas and not specific enough in others.
Huyghebaert says the changes include expanding the definition of “gang colours” to identify specific gangs by name.
The changes would also lower what was a $10,000 maximum fine and remove the one year in jail for a first-time conviction
