YULEE, Fla, No Criminal Charges In Deputy Shooting Death Of Unarmed Man(rider)

State Attorney's Office Makes Ruling After FDLE Investigation
YULEE, Fla. -- State Attorney Angela Corey said Tuesday that the Nassau County deputy who shot and killed 39-year-old Franklin "Ray" Bodden will not face any criminal charges.

Deputy Ernest Cole shot Bodden twice during a traffic stop on Sept. 11 on U.S. 1 in Callahan.

Bodden was riding a motorcycle with passenger Anthony Weeks when Cole pulled them over. Weeks was arrested on drug charges.

Bodden's family said that as he walked toward his motorcycle, he reached for something.

Cole believed Bodden may have been reaching for a weapon and shot him twice, deputies said. Bodden died later at Shands Jacksonville Medical Center. Deputies said he did not have a weapon.

Chuck DeYoung, Bodden's brother, said he watched dashboard camera video of the incident. He said the deputy asked Bodden to put his hands up, but said that before his brother could react, the deputy shot him.

DeYoung said his family cried when they learned Cole would not face any criminal charges.

Corey said the decision was made after the Florida Department of Law Enforcement completed its investigation.

The Nassau County Sheriff's Office will now conduct it's own internal investigation of the incident.
